Terms & Conditions

These terms and conditions govern all supply of goods and services ("products") by All Occasions Ltd -Trading as: All Occasions Hire and Elsie-May High Tea ("All Occasions") and All Occasions Gift Boxes to you, the hirer and purchaser of goods and services from us, including your use of the website at www.alloccasions.co.nz ("the website"). They are effective from 4 July 2021 and will replace all earlier All Occasions Ltd terms of trade and any conditions contained in any document used by you and purporting to have contractual effect. We reserve the right to change these terms of trade by notice to you. Notice may be given by posting the revised terms and conditions on our website.
We will always endeavour to have complete and accurate information on our website but to the greatest extent permissible by law we assume no responsibility for the completeness and current accuracy of the information provided on our website.
To the greatest extent permissible by law, we exclude all liability we may have to you for any claim except where we have acted in bad faith. This exclusion also applies for the benefit of every officer, employee, contractor, agent of us and anyone else we use to perform our duties or provide services under any agreement you have with us. None of the persons specified above is liable or has to pay you for anything else in connection with or resulting from anything any of us does or does not do, or delays in doing, whether or not it is contemplated or authorised by any agreement you have with us. This exclusion applies whatever you are claiming for and in whatever way liability might arise. This exclusion does not limit any inalienable rights you may have under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Applicable law and jurisdiction

Unless we otherwise agree in writing, this agreement contains all the terms of our relationship and continues to apply no matter where you are located at the time any goods or services are provided to you by us and irrespective of the location where you reside. Use of our website, supply of products or services by us to you and any other matter arising from these Terms and Conditions are subject to the laws of New Zealand. The Courts of New Zealand shall have non-exclusive jurisdiction over all claims or disputes arising in relation to, out of or in connection with these terms of trade, or with the use of website or supply of any services

Terms and Conditions: All Occasions Gift Boxes 1. Gift boxes and their content are as listed on our website: alloccasions.co.nz Photos are provided for illustrative purposes only. 2. Occasionally, we may need to substitute an item or items. We promise that the substitute item will be of the same or greater value. 3. We do not use couriers. Gift boxes are personally delivered by our staff. However, there may be circumstances beyond our control which result in delayed delivery/non-delivery eg: "acts of god", including weather, road closures, and also Covid-19 restrictions. All Occasions Ltd is not responsible or liable for any delivery delays/non delivery.

Terms and Conditions for hire and usage of items including Elsie-May High Tea events

By booking, hiring from and/or using the services of All Occasions Limited ("All Occasions"), All Occasions Hire, Elsie-May High Tea and other related trading entities, and agents acting on behalf of), you ("the hirer") agree to the following terms and conditions.

The following terms and conditions are subject to copyright to All Occasions Ltd and must not be copied or reproduced on any other website or business documentation. Please note (as at November 2021), due to Covid-19 we have amended our deposit and cancellation terms and conditions. Until further notice, no deposits required for high teas and hires. If an event cannot take place due to a change in Covid levels - no cancellation fees will be applied. A bond may still apply to hires.

1. The hirer is the person who enters into an agreement of hire (verbally, electronically, in writing or by any other means) or engages All Occasions to provide services.
2. At all times, all items hired and used remain the property of All Occasions.
3. Pricing is based on usage at one event, at a Hamilton location. Hires outside of Hamilton may be permitted at the discretion of All Occasions.
4. The hirer is at all times responsible for the safe keeping and return of the items hired, in an undamaged state.
5. China, crystal, glass and silverware need to handled with care due to their fragile nature. Do NOT put any hire items into a microwave, dishwasher or oven. Also, they must NOT be used on a stove or cook top. Any damage will be recoverable by All Occasions. Please place unwashed items back into the hire containers provided. All Occasions will take care of the washing up and sanitation process.
6. Even with all due care accidents can happen. If there is a breakage or damage, please keep the item (or pieces) to give back to All Occasions staff. A deduction will be made from the hire bond to cover the cost of replacing the destroyed or damaged item.
7. Unless specifically noted in the delivery/pick-up documentation, all items are assumed to be undamaged and in good working order.
8. The hire period is as agreed between All Occasions and the hirer and will be stated in the confirmation/booking documentation/communication. The extension of any hire period is at the sole discretion of All Occasions.
9. A 20% deposit is required to confirm all hire bookings, with payment of balance owing required prior to or on pickup or delivery.
10. For high tea bookings a 20% deposit is required to confirm booking and full balance and confirmation of number attending is due 5 days prior to event. The charges are based on number confirmed 5 days prior, not actual attendance numbers on the day of the event.
11. A bond payment of $50 (for damage and losses) applies to all hires and high teas. The bond will be refunded upon the return of all items, in good condition, without damage. Late return of items may also incur a loss of part or of the full bond payment and debt recovery processes. For damage/loss in excess of $50, additional charges will apply.
12. Payment options: All deposits can be paid via internet banking or by EFPOS or credit card or cash. We have mobile EFPOS. We accept Visa and Mastercard. A 2.5% bank charge applies to all credit card transactions. For online payments, please quote your name and booking reference number.
13. Cancellation policy: For High Tea events any cancellations must be made at least 5 days before your tea party. Late cancellations will incur a 20% cancellation fee and cancellations within 24 hours will incur a 50% cancellation fee. Failing to cancel will result in the full cost of the High Tea being due and no refund will be made.
14. Cancellation policy: For hire only bookings, no cancellation fee will be applied, subject to notification being received by All Occasions more than 24 hour prior to agreed delivery or pick up date/time. Cancellations or non-collections within 24 hours of the agreed delivery or pick up date/time will incur a 20% cancellation fee.

Privacy Act 2020: Privacy Statement

All Occasions Ltd (and associated trading entities) collects personal information from you, including information about your name, contact information, other information you provide as part of your inquiry or booking request, and computer or network interactions with us. We collect your personal information in order to respond to and communicate with you about your inquiry and/or booking. Providing some information is optional. If you choose not to provide some of the information on our online contact form or by phone, email or other communication channel, it may be difficult to respond to your inquiry and we may not be able to confirm a booking.

You have the right to ask for a copy of any personal information we hold about you, and to ask for it to be corrected if you think it is wrong. If you would like to ask for a copy of your information, or to have it corrected, please contact us by emailing: alloccasionslimited@gmail.com

We respect your privacy. Your information will be kept security by All Occasions Ltd and will not be passed on, disclosed or sold to any third party or other business, unless required by law or for the purposes of debt collection or recovery of All Occasions property. If you place an order for tea products, with your agreement, we may pass your contact details onto Qual-Tea Elmstock Premium Quality Teas so that your order can the processed and delivered to you.
